Terms and Conditions of use for our Autoresponder service

Users of our Autoresponder service must ensure that they operate each Autoresponder account in strict accordance with the general usage conditions set out below. Our terms of use are fair and serve to protect you, as our customer, your own customers and The Autoresponder.co.uk. If you have any questions not answered below please contact support using the menu above.

1. Introduction

1.1 Autoresponder Services The following Services (together "the services" are currently available on this site:

1.1.1"The Business Service" whereby you may subscribe to the Business Service described on this site, including your licence to use the Autoresponder e-mail router and the server for the purposes of the Business Service, by entering your details through the on-line registration form and paying the charges from time to time specified on this site.

1.1.2 "Managed Email Marketing Plan":This service is optional and an additional service available on a bespoke basis. In each instance we will prepare a quotation itemising the content to be included, and the cost to the client

1.1.3 "Email copy writing service and HTML email production service" Both are optional and available on a bespoke basis. In each instance we will prepare a quotation itemising the content to be provided and the cost to the Client.

1.1.4 Purchase of opt-in mailing lists. We do not permit the upload and mailing of purchased mailing lists - to prevent this we throttle your bulk upload ability to 100 subscribers a day. This does not affect how many people can subscribe via your web form per day. It is also your responsibility to make sure your mailing copy and claims contained therein are in compliance with all relevant laws

1.1.5 "Developer Accounts" - All accounts opened direct through our website or through Developer Accounts become clients of 'The-Autoresponder" - Multi-Account Developer accounts offered at a discount simply allow developers to benefit from paying less for bulk accounts and charging more to the end user (if they wish) - all end users may from time to time receive emails from The-Autoresponder admin and are able to contact The Autoresponder Support Desk direct for support on their Autoresponder system and email campaigns.

1.2 It is a condition of your using the Services that you accept and agree to be bound by these Conditions. If you do not agree to be bound by these Conditions, you should not use the Services.

1.3 We reserve the right, at our discretion, to make changes to any part of this site, including these Conditions. If these Conditions are changed, we will notify you by e-mail or by publishing details of those changes on this part of this site. If you use the Services after we has published or notified you of such changes, you thereby agree to be bound by those changes. If you do not agree to be bound by those changes, you should not continue to use the Services any further.

1.4 Headings in these Conditions are for convenience only and have no legal meaning or effect.

2. Providing information to The Autoresponder.co.uk

2.1 By registering your details, you warrant and undertake that you are doing so in the course of your business and that your registration details are true and accurate in all respects.

2.2 By Registering your details you consent to them being held on the Autoresponder server located in the UK. Your details will be processed in accordance with the Data Protection Act 1998 and the privacy policy relevant to the service you have subscribed to. You may withdraw your consent at any time by notice to support@the-autoresponder.co.uk in which case the service you have subscribed to will be terminated after 7 days.

3. Your Responsibilities

3.1 At all times you are responsible for retaining the confidentiality of your password and ensuring that it is not disclosed to unauthorised people. Should you believe that the password is known to unauthorised people then you must immediately email support@the-autoresponder.co.uk to change your password.

3.2 You will at all times comply with the E-Mail Rules below

3.3 You will obtain all necessary licences and permissions required throughout the world, and will comply with all legal and regulatory requirements and other applicable codes, including (without limitation) data protection requirements, for all activities which you conduct in using the Services. Without prejudice to the generality of the foregoing, if in using the Services you generate any data from data subjects located outside the European Economic Area, you will promptly notify them that their data is held on The Autoresponders servers in the UK and will be subject to UK data protection requirements but that the standard for data protection of their data should not be considered to be greater than that in the country or territory where they are located.

3.4 You agree to indemnify and hold harmless the company, its officers, employees, agents and third parties (including internet service providers) from all costs, liabilities, penalties and claims for damages (whether direct or indirect) arising from you using the Services or breaching any data protection or other legislation or regulatory requirements or codes worldwide or submitting any electronic communication through the Autoresponder e-mail router or from any breach by you of these Conditions.

3.5 By submitting any electronic communication through the Autoresponder e-mail router, you automatically grant, and you represent and warrant that you have the right to grant, to us an irrevocable, perpetual, non-exclusive and unconditional licence to use, copy and distribute, such communication in the performance of the Services.

3.6 We reserve the right at any time, without liability, to remove all or any data from the server if it reasonably believes that there has been a breach of any of these Conditions in relation to such data.

4. Quotations

A quotation by us does not constitute an offer and we reserves the right to withdraw or revise the same at any time prior to our acceptance of the Clients' order.

5. Date and manner of performance by The Autoresponder.co.uk

The obligations undertaken by The-Autoresponder regarding formulation of Customised Plans, email copy writing and HTML email preparation shall be carried out within such time limits as may be agreed between us and the Client, or in the absence of any such agreement, within such time limit as may be reasonable in the circumstances. We reserve the right to fulfil our obligations to the Client by the use, in appropriate cases, of independent third party contractors.
